INFORMATION CLAUSE ON THE PROCESSING OF PERSONAL DATA 

According to Art. 13 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”), InnoEnergy Central Europe sp. z o.o. with registered office in Krakow, Poland informs that:

  1. The data controller of your personal data is InnoEnergy Central Europe sp. z o.o. with registered office in Krakow at 28 Wielicka Street, 30-552 Krakow, Poland (“Controller”).
  2. The Controller can be contacted at the address of its seat as indicated in sec. 1.1. above, and via the following e-mail address: central.europe@innoenergy.com
  3. Personal data provided to the Controller by you shall be processed by the Controller from the moment of sending the registration form.
  4. The online training is performed by the Controller in connection of the implementation of the INTERREG CENTRAL EUROPE project CE1312 InNow (“InNow Project”) based on the contract with City of Vienna acting as Managing Authority of the European Territorial Cooperation Programme INTERREG CENTRAL EUROPE. Personal data provided by you to the Controller will be made available to City of Vienna for the purpose of reporting to City of Vienna as Managing Authority by the Controller in InNow Project. The basis of data processing is the legitimate interest of the Controller (Article 6(1) point (f) GDPR) in the performance of activity in InNow Project.
  5. Recipients of personal data also include: cooperating entities responsible for implementing the online training; IT service providers (e.g. email, hosting, platforms to organize online format events); service providers supporting the Controller in the implementation of the online training.
  6. Personal data provided to the Controller by you will be processed by the Controller for the following purposes and on the following basis related to the online training:
    1. For the performance of the online training, particularly communication with the participants before and during the online training – the basis of data processing is the necessity to enter into the contract with the participant and the performance of the contract concerning the participation in the online training (Article 6(1) point (b) of the GDPR;
    2. For the performance of obligations connected with implementation of InNow Project, in particular reporting obligations – the basis of processing is the legitimate interest of the Controller (Article 6(1) point (f) GDPR), which is the performance of activity in InNow Project;
    3. For the establishment, exercise or defense of potential legal claims, including after the online training is finished – the basis of data processing is the legitimate interest of the Controller (Article 6(1) point (f) GDPR), which is the defense of its rights.
  7. Provision of personal data in the registration form for the purposes of applying to participate in the online training and in registration forms to the platforms used by the Controller to organize online format events is a requirement necessary to participate in the online training. Failure to provide this data precludes the possibility to participate in the online training. Provision of personal data for the purposes of complaints is a contractual obligation and is necessary to process complaint.
  8. Your personal data will be processed by the Controller for the following period:
    1. Regarding the data processed to implement the online training – for the duration of the online training;
    2. Regarding the personal data processed for the performance of obligations connected with implementation of InNow Project, in particular reporting obligations – until the expiry of potential obligations connected with carrying out InNow Project concerning the online training;
    3. For the establishment, exercise or defense of legal claims – until the expiry of material claims concerning the online training.
  9. You enjoys the following rights according to the GDPR:
    1. the right to access to the personal data concerning the data subject, its rectification, erasure, and restriction of processing;
    2. the right to data portability (concerning data processing carried out by automated means on the basis of consent: Article 6(1) point (a) GDPR or contract: Article 6(1) point (b) GDPR), that is the right to receive the personal data you have provided to the Controller, in a structured, commonly used and machine-readable (computer) format; if it is technically possible, you have the right to have the data transmitted to another controller;
    3. with regard to data processed based on a legitimate interest (Article 6(1) point (f) GDPR) – the right to object to processing;
    4. the right to lodge a complaint with a data protection supervisory authority, in particular in the Member State of their habitual residence, place of work or of the alleged infringement, if you consider that the processing of personal data relating to you infringes the GDPR. The supervisory authority in Poland is the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych).
  10. Your personal data will not be subject to automated processing, including profiling.
  11. As regards the performance of the online training in cooperation with cooperating entities located in non- EEA (European Economic Area) countries (third countries), personal data provided by the participants will be, to the extent necessary, transferred to the third country of those cooperating entities supported the Controller in organization of the online training. The data transfer is performed subject to appropriate safeguards. The Controller enters into contracts with non-EEA Partners according to the standard contractual clauses for the transfer of personal data to processors established in third countries, approved by the European Commission decision 2010/87/EU of 5 February 2010.   12. As regards the performance of the online training, the Controller utilizes IT services performed by entities located in the USA (such as Google). Data transfer to the USA is performed within the “EU-U.S. Privacy Shield” framework. According to European Commission decision 2016/1250, the USA is considered to ensure an adequate level of protection for personal data transferred from the European Union to organizations established in the USA, provided that such organizations are included in the “Privacy Shield” list. CONSENT TO PROVIDING MARKETING INFORMATION 

I agree to the processing of my personal data indicated in the registration form by InnoEnergy Central Europe sp. z o.o. with registered office in Krakow, Poland for marketing purposes in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”).

Consent is voluntary, but its lack will prevent InnoEnergy Central Europe sp. z o.o. from providing marketing information, including information about new online trainings and other events. This consent covers data processing in the future, unless the purpose of processing changes.

The personal data will be processed for marketing purposes pursuant to art. 6 sec. 1 lit. a GDPR, i.e. my consent.

I have the right to withdraw my consent at any time (data are processed until the withdrawal of consent). I have the right to access, rectify, delete or limit processing of the data, the right to object, the right to submit a complaint to the supervisory authority or transfer the data.

The personal data may be shared:

1) entities providing technical support in the field of IT support for InnoEnergy Central Europe sp. zo.o.,

2) entities providing InnoEnergy Central Europe sp. z o.o. with services necessary for theimplementation of organizational support,

3) entities authorized under the law.

Your personal data will not be subject to automated processing, including profiling.

The personal data may be transferred to the entities located in non-EEA (European Economic Area) countries, including USA supported InnoEnergy Central Europe sp. z o.o. in providing marketing information (such as Google). The data transfer is performed subject to appropriate safeguards.

CONSENT TO SEND COMMERCIAL INFORMATION BY E-MAIL 

I agree to receive from InnoEnergy Central Europe Sp. z o.o. via electronic means of communication to the e-mail address provided by me in the registration form for commercial information regarding products and services, in particular trainings and events, offered by Central Europe Sp. z o.o. within the meaning of the Act on the provision of electronic services of July 18, 2002 (Dz. U. from 2020, item 344 with changes).
